Dryline — Terms of Service

These Terms of Service ("Terms") govern your use of dryline.farm and related services (the "Service"), operated by [[ENTITY — Montana LLC formation pending confirmation]] ("Dryline," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You're responsible for your account, for keeping your credentials secure, and for all activity under your account. Provide accurate information and keep it current.
2. What the Service is
Dryline provides: (a) drought information drawn from public sources such as the U.S. Drought Monitor, NOAA, and the National Weather Service; (b) indicators and estimates relating to the USDA Livestock Forage Disaster Program (LFP) and related programs; and (c) a marketplace where users can list, find, buy, sell, or donate hay and forage. We may add, change, or remove features at any time.
3. No professional advice
The Service provides general information and estimates for planning purposes. It is not legal, financial, tax, agronomic, veterinary, or professional advice, and is not a substitute for your own judgment or the advice of qualified professionals or the relevant government agency.
4. Government programs and LFP estimates — important
Dryline is not affiliated with, endorsed by, or acting on behalf of the USDA, the Farm Service Agency (FSA), or any government agency. Any drought conditions, eligibility indicators, deadlines, or payment figures shown in the Service — including figures in alert emails — are unofficial estimates for planning purposes only, based on publicly available data and program rules that may change or contain errors. They are not a determination of eligibility and not a guarantee that you will receive any payment or amount.
Actual eligibility, deadlines, and payment amounts for LFP and any other program are determined solely by FSA/USDA. You are responsible for confirming current rules, filing the required forms (such as CCC-853) with your local FSA office, and meeting all deadlines. Dryline is not responsible for any application, decision, missed deadline, denied benefit, or payment outcome.
5. Marketplace — Dryline is a venue, not a party
The marketplace lets users connect directly. Dryline is not a party to any transaction between users and does not buy, sell, possess, inspect, transport, store, or guarantee any hay, forage, or other goods, and does not handle or guarantee any payment. We do not verify listings, prices, quantities, quality, forage-test results, descriptions, photos, or the identity, trustworthiness, or legal authority of any user. A "verified phone" or similar badge means only that a step was completed — it is not a guarantee about any user.
All transactions, communications, payments, inspections, pickups, deliveries, and arrangements are solely between the users involved, at their own risk. You are responsible for evaluating listings, verifying details, inspecting hay, confirming weights and quality, arranging and insuring transport, and complying with all applicable laws (including weights/measures, weed/noxious-seed, transport, and tax rules). Dryline is not liable for any dispute, non-payment, non-delivery, loss, injury, or damage arising from a listing, communication, or transaction.
6. In-person interactions and transport — assumption of risk
Using the marketplace may lead to meeting other people, visiting private property, handling equipment and livestock feed, and hauling hay on public roads. You understand these activities carry real risk. You assume all risk of your interactions, visits, inspections, loading, and transport, and you agree that Dryline is not responsible for any personal injury, property damage, vehicle accident, or other loss arising from them. To the fullest extent permitted by law, you release Dryline and its owners from claims arising out of your dealings or in-person interactions with other users.

7. User content and conduct
You retain ownership of content you submit (listings, messages, reviews, feedback). You grant Dryline a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and use that content to operate, promote, and improve the Service. You agree not to: post false, misleading, illegal, or infringing content; post listings you are not authorized to sell; harass or harm other users; submit fake reviews; scrape or misuse the Service or its data; attempt to circumvent security; or use the Service for anything unlawful. We may remove content or suspend accounts that violate these Terms, at our discretion.
8. Intellectual property
The Service, including its design, software, and branding, is owned by Dryline and protected by law. Public data displayed in the Service belongs to its respective sources and is subject to their terms. You may not copy, resell, or create derivative services from the Service without permission.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY DATA, ESTIMATE, OR LISTING IS ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DRYLINE AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, MISSED BENEFITS OR DEADLINES, PERSONAL INJURY, PROPERTY DAMAGE, OR TRANSACTION LOSSES, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Dryline and its owners from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your transactions or in-person interactions with other users, or your violation of these Terms or any law.
12. Termination
You may stop using the Service and request account deletion at any time. We may suspend or terminate access if you violate these Terms or for any lawful reason.
13. Governing law
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-laws rules.

14. Miscellaneous
If any provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a business transfer. These Terms are the entire agreement between you and Dryline about the Service. We are not liable for delays or failures caused by events beyond our reasonable control.
15. Changes
We may update these Terms. We'll post the new effective date and, for material changes, provide reasonable notice. Continued use after changes means you accept them.
